These Terms of Service ("Terms") constitute a legally binding agreement between you and Cloud9 Esthetics ("Company," "we," "us," or "our"), governing your access to and use of the website and all associated services, software, and content (collectively, the "Services").
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use our Services.
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement.
Cloud9 Esthetics provides professional esthetic services, skincare treatments, waxing, and client care support in Charlotte, NC. Our Services include, but are not limited to:
• Waxing and esthetic treatment services
• Skincare consultations and facial treatments
• Appointment scheduling and client support
• Client care communication and follow-up
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice.
To access certain Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
Each account is for a single user. Account sharing or providing credentials to third parties is prohibited unless explicitly authorized in writing by the Company.
Service pricing is set at the time of booking. Cloud9 Esthetics reserves the right to update pricing at any time. Current pricing is available by contacting us directly.
All payments are processed securely through our designated payment processor. We collect and store payment information in accordance with applicable payment card industry standards. We do not store full credit card numbers on our servers.
You may cancel or reschedule appointments by contacting Cloud9 Esthetics at 980-890-4763 or [email protected]. Please provide adequate notice prior to your scheduled appointment. Late cancellations or no-shows may be subject to fees.
ALL SALES ARE FINAL. We do not offer refunds on services rendered. This includes but is not limited to:
• Completed esthetic and waxing services
• Deposits or prepaid appointment fees
• Any payment plan installments already collected
By completing a purchase or booking, you acknowledge and agree to this no-refund policy. We encourage you to review all service descriptions carefully before booking and to reach out to us at [email protected] with any questions prior to your appointment.
In the event of a technical error or duplicate charge on our part, we will investigate and issue a correction or credit as appropriate.
All content included in or made available through our website and Services, including but not limited to text, graphics, logos, images, and digital content, is the property of Cloud9 Esthetics and is protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our website and content solely for your own personal use in connection with our Services.
You may not: (a) copy, modify, or distribute our content to third parties; (b) reverse engineer or attempt to extract source code from any software we use; (c) resell or sublicense access to our Services; or (d) use our content to build competing products or services.
You agree not to use our Services to:
• Violate any applicable federal, state, local, or international law or regulation
• Send unsolicited commercial messages (spam) or conduct any form of harassment
• Collect or harvest personal information about other users without their consent

• Upload or transmit any content that is unlawful, defamatory, obscene, or otherwise objectionable
• Interfere with or disrupt the integrity or performance of our website or Services
• Attempt to gain unauthorized access to any portion of the Services or related systems
• Use the Services in any manner that could damage our reputation or that of our affiliates
By providing your contact information, you consent to receive communications from Cloud9 Esthetics related to your appointments, services, and client care. Standard message and data rates may apply for mobile communications. You may opt out of communications at any time by contacting us at [email protected].
Our Services may integrate with or rely upon certain third-party services and platforms. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or availability of any third-party services.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Individual results from esthetic services may vary.
The information provided through our Services is for general informational purposes only and does not constitute professional medical or dermatological advice.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLOUD9 ESTHETICS, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.
Our total cumulative liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to us in the 12-month period preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Cloud9 Esthetics, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall first be subject to good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Mecklenburg County, North Carolina.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a revised effective date. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms.
